Introduction

Welcome to Behold. These Terms of Use ("Terms") govern your access to and use of the Behold mobile application ("App") and related services provided by Next Wave Apps ("we," "us," or "our").

By creating an account or using Behold, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use the App.

Please also review our Privacy Policy, which describes how we collect, use, and protect your personal data.

Account Requirements

Age Requirements

You must be at least 16 years of age to create an account and use Behold. By creating an account, you represent and warrant that you meet this age requirement.

Users between 13 and 16 years of age may use the app with parental or guardian consent, but account creation is restricted to users 16 and older.

Account Registration

To access certain features of Behold, you must create an account using Apple ID or Google Sign-In. You agree to:

Provide accurate and complete information
Maintain the security of your account credentials
Promptly update any changes to your information
Accept responsibility for all activities that occur under your account

Acceptable Use

When using Behold, you agree NOT to:

Bypass or defeat app restrictions or blocking features
Interfere with app locking features or Screen Time functionality
Reverse engineer, decompile, or disassemble the app
Modify or create derivative works based on the app
Use the app for any unlawful purpose
Attempt to gain unauthorized access to our systems or networks
Use the app in any way that could damage, disable, or impair our services
Violate any applicable laws or regulations

Subscription Terms

Plans Available

Behold offers the following options:

Free Plan: Basic features at no cost

Premium Subscription: Enhanced features available through:

Weekly subscription
Monthly subscription
Yearly subscription

Billing and Renewal

Subscriptions are billed in advance on a recurring basis (weekly, monthly, or yearly)
Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period
Your account will be charged for renewal within 24 hours prior to the end of the current period

Managing Your Subscription

You can manage and cancel your subscription through:

App Store purchases: Your Apple App Store account settings
Web purchases: Your account on our website (usebehold.com)

Price Changes

We reserve the right to adjust pricing at any time. Any price changes will be communicated in advance and will apply to subsequent billing periods.

Refund Policy

Web Purchases

For yearly subscription purchases made through our website (usebehold.com), we accommodate refund requests made within 30 days of your purchase.

Use the same email address that was used for the original purchase

App Store Purchases

For purchases made through the Apple App Store, refunds are handled by Apple according to their refund policies. Please contact Apple Support or request a refund through your Apple account.

App Functionality

Screen Time Features

Behold uses Apple's Screen Time API, FamilyControls, and ManagedSettings frameworks to provide app blocking and focus features. You understand that:

You control which apps are blocked and when restrictions are active
You can revoke Screen Time authorization at any time through your device's Settings
The effectiveness of these features depends on Apple's APIs

User Control

You maintain full control over:

Which apps are selected for restriction
When practices and boundaries are active
All Screen Time permissions and authorizations

Service Availability

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

Please understand that:

Screen Time limits and app blocking are user-controlled features
DeviceActivity and FamilyControls features depend on Apple's APIs and may not be 100% reliable
Practices and boundaries are tools to support your goals, not guarantees of behavior change
We do not guarantee uninterrupted or error-free service
Features may change or be discontinued at any time

Behold is a digital wellbeing tool. It does not provide medical, psychological, or professional advice. If you have concerns about screen time, addiction, or mental health, please consult a qualified professional.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NEXT WAVE APPS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

Loss of profits or revenue
Loss of data
Loss of goodwill
Business interruption
Any other intangible losses

This limitation applies regardless of the theory of liability (contract, tort, or otherwise) and even if we have been advised of the possibility of such damages.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you.

Intellectual Property

Our Rights

Behold, including its design, features, content, and trademarks, is owned by Next Wave Apps and protected by intellectual property laws. You may not:

Copy, modify, or distribute the app or its content
Use our trademarks without permission
Remove any copyright or proprietary notices

Your Content

You retain ownership of any content you create within the app. By using Behold, you grant us a limited license to process your content as necessary to provide the service.

Termination

By You

You may stop using Behold at any time by:

Deleting your account through the app
Contacting us at [email protected]

By Us

We may suspend or terminate your account if you:

Violate these Terms of Use
Engage in fraudulent or illegal activity
Engage in conduct that we determine is harmful to other users, us, or third parties

Upon termination, your right to use the app ceases immediately. Provisions that by their nature should survive termination will remain in effect.

Governing Law and Dispute Resolution

Governing Law

These Terms are governed by the laws of The Netherlands, without regard to conflict of law principles.

Dispute Resolution

For EU Residents: In accordance with EU consumer protection laws, any disputes may be resolved in the courts of your usual place of residence. You also have the right to lodge a complaint with your local consumer protection authority.

For Non-EU Residents: Any disputes shall be resolved in the courts of Rotterdam, The Netherlands.

Informal Resolution

Before filing any formal complaint or legal action, we encourage you to contact us at [email protected] to attempt to resolve the dispute informally.

Changes to These Terms

We may update these Terms from time to time. When we make changes:

We will update the "Last Updated" date at the top of this page
We may notify you through the app or via email for significant changes
Changes are effective 30 days after posting

Your continued use of Behold after changes become effective constitutes acceptance of the updated Terms. If you do not agree to the changes, please stop using the app.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Next Wave Apps regarding your use of Behold and supersede any prior agreements.
